Electronic Business: Acceptable Use Policy

e-manumit.com's aim is to provide merchants with a top quality electronic commerce service.

Internet commerce provides exciting new business opportunities, but it also imposes obligations.

This Acceptable Use Policy is a guide to using e-manumit.com's e-business services. It includes your responsibilities, and outlines what e-manumit.com considers unacceptable and prohibited use of the service. Please read this document together with your written Agreement with e-manumit.com for a complete overview of your obligations.

Definitions

"Customer"
A person using Your e-business web site to purchase goods and/or services which You advertise there.
"e-business"
The electronic commerce/business services provided by us.
"Us/We/Our/e-manumit.com"
e-manumit.com
"You/Your"
The merchant who has bought the e-manumit.com service.

Your Obligations and Responsibilities

  1. You must comply with the following documents,[any of which e-manumit.com may amend at its sole discretion from time to time]:
    • this Acceptable Use Policy;
    • any associated acceptable use policies and conditions of use regarding e-manumit.com;
    • any conditions of use or acceptable use policies for other e-manumit.com services which You may have purchased, or purchase in the future, or those of any other Internet service provider whose services You are using.

e-manumit.com may revise the Acceptable Use Policy, it's conditions of use or other acceptable use policies at any time at it's sole discretion, and your use of e-business services following such revision will constitute Your acceptance of such revised terms.

You are Your Customers' point of contact for all queries and problems connected with their use of the Service. This includes responsibility for any problems relating to refunds, delivery of products and charges applied to customers' credit cards.

  • You are responsible for:
    • ensuring the accuracy and completeness of the content of Your e-business web site;
    • entering accurate information regarding the products and services offered on Your web site;
    • compiling the terms and conditions of shopping for your e-business web site which You shall make available on the site;
    • using Your best endeavours to promptly fulfil orders made by a Customer and deliver all products ordered by a Customer to that Customer;
    • checking the accuracy of orders and prices submitted by Customers via Your e-business web site;
    • complying with all applicable laws and regulations. Including, but not limited to, You must not make available any product or content which is defamatory, menacing or obscene, confidential, in breach of any third party intellectual property right (including copyright) or in breach of any other third party right;
    • complying with the Data Protection Acts 1984 and 1998, regarding all information received, stored or communicated through the use of Your e-business web site.

You must not harm (or attempt to harm) the integrity, security and/or availability of e-business or any e-manumit.com network.

  • Any password(s) which We supply You with and any employee password(s) You create to use e-business are Your responsibility and should not be disclosed to any third party or unauthorised person. Failure to protect Your password(s) may make You liable for any losses You incur if they are misused.
  • You must not offer or distribute any of the following products or services:
      1. software for sending "spam" (bulk emails, excessive news postings, etc.)
      2. lists of email addresses, except where all the addresses' owners have given their explicit permission.
    • When the public visits Your e-business web site they must see a clearly readable warning page before any offensive or adult material is displayed.

    Limitations of e-manumit.com's Liability

    e-manumit.com is not liable for:

    • the content and/or information stored on Your web site, or any laws or regulations which Your web site and/or products may breach;
    • the configuration of Your store on Your web site;
    • the products advertised by You or sold directly, or indirectly, through Your web site, including any legal action taken against You regarding any illegal products and/or services. You indemnify e-manumit.com against any such action;
    • loss of any data, information or transactions (unless due to server failure or other technical problem with the e-business service which is the fault of e-manumit.com). You are responsible for retaining copies of relevant data. e-manumit.com will not keep backups of Your pages;
    • any financial loss whatsoever which You may suffer as a result of using e-business or due to e-manumit.com's suspension of e-business;
    • any unpaid debts which You may have from using e-business;
    • any refunds or credits which may become due to Your Customers from using e-business

    General

    e-manumit.com will enforce sanctions it deems appropriate against any of its customers whose e-business web sites infringe this acceptable use policy. Such sanctions may include, but are not limited to, a formal warning, barring or suspending the customer's e-business web site, suspension of access to the Internet through e-manumit.com, or termination of the customer's account(s). If a suspension of access to the Internet is imposed, then this may be lifted at e-manumit.com's sole discretion, when the original problem has been rectified and upon receipt of a formal written undertaking from the customer that he/she will not breach e-manumit.com's policies in the future.

    e-manumit.com reserves the right to remove any material from a e-business at its sole discretion, without prior notice and without explanation.

    Any decision e-manumit.com makes in relation to Your use of e-business is final.
